Terms & Conditions
These terms and conditions ("Terms and Conditions") govern the relationship between Luxura Travel Design LLC ("LTD," "we," "us," or "our") and you, the purchaser or traveler ("Client," "passenger," "you," or "your"). By planning travel with LTD, you agree to be bound by these terms and acknowledge that LTD acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services ("Supplier(s)") and is not the source or provider of the travel services. These terms include warranties, disclaimers, and exclusions of liability and may restrict your rights and remedies while providing protection to LTD.
Use of LTD Services and Travel Bookings
You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with LTD. You agree to be financially responsible for all travel bookings made with us, whether on behalf of yourself or other members of your traveling party. You warrant that all information supplied by you is true and accurate. You agree to make only legitimate reservations or purchases with LTD and its Suppliers, and acknowledge that any speculative, false, or fraudulent reservation is prohibited.
LTD accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services. By booking through LTD, you agree to the booking terms of each Supplier partner selected for your itinerary.
LTD is not liable or responsible for any arrangements made independently. LTD assumes no responsibility for costs or fees you incur for independent arrangements not booked through us, including airline, hotel, excursion, and travel protection related charges. If you make your own flight arrangements, LTD is not responsible for any loss resulting from cancellation or changes in international gateways, itineraries, or travel dates.
Luxura Travel Design LLC is registered in Louisiana as a seller of travel. Registration as a seller of travel does not constitute approval by the State of Louisiana.
Right to Correct Errors
We reserve the right to correct errors in pricing or other information. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. We advise confirming reservations well in advance to avoid disappointment, fare increases, and additional late booking fees.
Payments, Cancellations, and Changes
You are responsible for all charges, fees, duties, taxes, and assessments arising from your travel bookings through LTD. By submitting a credit card authorization form, you agree to allow LTD to use your payment method to purchase travel products from our Suppliers on your behalf.
EXCEPT IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF WTC OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF WTC OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE, OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, WTC RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES, AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL, OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.
All payments for travel are due prior to departure according to each Supplier's terms and conditions. Failure to make final payment or violation of a Supplier's conditions may result in cancellation of your reservations, denied access to travel services, or forfeiture of monies paid. In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation. All cancellation requests must be sent to LTD in writing. Cancellation penalties from LTD and third-party Suppliers may apply.
Travel Documents and Identification Requirements
It is the responsibility of each Client to obtain and carry a valid passport book, visa(s), and all other required documents. Passport cards are not accepted for most international travel. For domestic and international travel, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) require acceptable identification to board flights. Examples include DHS-designated enhanced driver's licenses, US passports, or foreign government passports.
Many countries will not admit passengers whose passports expire within six (6) months of the return date. Non-United States citizens may require additional documentation. You are responsible for informing LTD when traveling on a passport from a country other than the United States of America. LTD neither controls nor warrants the issuance of visas or approval of visa waivers. Should a visa not be issued, LTD is not responsible for lost payments made toward your trip.
Health and Safety
Immunizations and Health Requirements
You must have proper immunizations, health screenings, and required documentation before travel. LTD shall not assume responsibility for the accuracy of health requirements or documentation prior to departure or upon arrival. Required inoculations must be recorded by your health practitioner on a valid vaccination certificate, which you must carry for proof of inoculation where required.
Travel Risks and Safety
Travel to certain destinations may involve greater risk than others. LTD urges Clients to stay informed about current events and review travel advisories issued by the United States Government before booking international destinations. We recommend registering with the Smart Traveler Enrollment Program (STEP) for international travel.
BY OFFERING TRAVEL TO PARTICULAR DESTINATIONS, LTD DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT'S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT'S OWN RISK.
Air Travel and Transportation
Your airline ticket represents a contract between you and the air carrier, even if purchased through LTD. You acknowledge that LTD does not control airline operations and agrees that LTD is not liable for any injury, damage, loss, accident, delay, or irregularity related to air travel.
LTD functions solely as a booking agent for air carriers and does not handle or hold client funds for airline tickets. Any refunds for cancelled or delayed flights, baggage fees, or seat assignments must come directly from the airline.
Limitations of Responsibility
LTD acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to LTD's control.
BECAUSE LTD ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, LTD IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM THESE SERVICES. LTD DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES.
Force Majeure
LTDwill not be liable for any failure or delay in performing obligations due to causes beyond its reasonable control, including acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantines, civil commotions, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstances.
Travel Insurance
LTD STRONGLY RECOMMENDS THE PURCHASE OF TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT. Unless specifically noted, travel insurance is not included in the cost of your itinerary. Without appropriate travel insurance, you understand that cancellation penalties will apply and that you may forfeit up to the full cost of your travel booking and related costs.
Legal Jurisdiction
These Terms and Conditions are governed by the laws of the State of Louisiana. You consent to the exclusive jurisdiction and venue of courts in Louisiana in all disputes arising out of or relating to travel bookings with LTD. Any claim against LTD must be brought within 12 months after the trip completion date.
Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Updated versions will be provided to Clients, posted on our website, and effective immediately upon posting.
These Terms and Conditions constitute the entire agreement between the Client and WTC with respect to travel bookings made with LTD by any means, superseding all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
